Donald R. Spaccio, who served as a justice of the Montour Falls Village Court since 2001 and the Montour Town Court since 2005, resigned from both positions in September 2024 following a New York State Commission on Judicial Conduct investigation. The Commission notified Spaccio in April 2024 that it was investigating several matters, including his attendance at the January 6, 2021 rally in Washington, D.C. — conduct the Commission determined was impermissible for a sitting judge — along with two separate incidents of unprofessional conduct: shouting at law enforcement officers who asked him to remove a propane cannon from his property, and yelling profanities at a town code enforcement officer during an unrelated dispute. Spaccio testified he did not participate in the Capitol riot itself, saying only that he attended a rally beforehand. Under the stipulation he agreed to with the Commission, Spaccio vacated both of his judicial positions and is permanently barred from holding judicial office in New York again.
