Western NY Judge Resigns After Invoking Office in Attempt to Avoid Traffic Ticket, Judicial Conduct Watchdog Says
New York Law Journal
Published: November 03, 2025
Ian E. Penders, a justice of the Clarkson Town Court in Monroe County, New York, resigned in October 2025 while under investigation by the State Commission on Judicial Conduct. The Commission opened its inquiry in August 2025 over a complaint alleging that during two separate police stops on the same day, June 20, Penders invoked his judicial office in an attempt to avoid being written a ticket — one stop resulted in a misdemeanor charge and the other an unlicensed-driving violation. Penders pleaded guilty to unlicensed driving on August 15, 2025, and paid a $100 fine. He submitted his resignation in an October 22 letter to Clarkson's town supervisor, effective October 30, and agreed as part of a formal stipulation not to seek or accept judicial office in New York again.
