Mark Cohen Suspended Retired

Mark B. Cohen, a Philadelphia Court of Common Pleas judge, was suspended by Pennsylvania's Court of Judicial Discipline in October 2024 after a trial over whether 66 of his Facebook posts violated the state constitution and judicial conduct rules. The court found the "tone" and "volume" of the posts — which touched on former U.S. Rep. Liz Cheney, the hammer attack on Nancy Pelosi's husband, Governor Josh Shapiro's election, and other state and national political issues — crossed the line into impermissible partisan activity for a sitting judge, especially after Cohen refused to stop posting despite warnings. The Pennsylvania Supreme Court upheld the suspension in January 2026. The suspension ran through the end of his term, which ended December 31, 2024 due to Pennsylvania's mandatory judicial retirement age. Cohen appealed to the U.S. Supreme Court, seeking a ruling on the constitutional limits of restricting a judge's political speech... and he lost again.
